These Terms of Service (“Terms”) govern your use of the Peak Property Media website, forms, questionnaires, consultations, and services. By using our website, submitting information, booking a service, or engaging Peak Property Media (“PPM,” “we,” “us,” or “our”), you agree to these Terms.

Services

Peak Property Media provides real estate photography, drone photography, video, virtual staging, marketing media, consultation, education, and related services. The specific scope, price, delivery schedule, and requirements for each project may be established through an estimate, booking, order, written agreement, email, or other communication.

Bookings and Property Access

Clients are responsible for providing accurate property information, confirming appointment details, obtaining necessary permissions, and ensuring that the property is ready and safely accessible at the scheduled time.

The client is responsible for notifying occupants, agents, property owners, and other necessary parties about the appointment and for providing lawful access to the property.

Pricing and Payment

Prices may vary based on property size, location, services selected, travel, special requests, and project complexity. Payment terms will be communicated when services are booked or invoiced.

Unless otherwise agreed in writing, amounts due must be paid according to the invoice or booking terms. Applicable taxes, travel charges, or additional-service fees may be added where appropriate.

Cancellations and Rescheduling

Clients should provide reasonable notice when canceling or rescheduling. Peak Property Media may charge a cancellation, travel, or rescheduling fee when inadequate notice is provided, when a property is inaccessible, or when the property is not ready at the scheduled time.

Weather, safety concerns, equipment issues, illness, or circumstances beyond our reasonable control may require rescheduling.

Turnaround and Delivery

We aim to deliver media within the turnaround time communicated at booking. Delivery times are estimates and may be affected by project scope, weather, access, technical issues, revision requests, or other circumstances beyond our reasonable control.

Client Responsibilities

Clients are responsible for reviewing delivered materials promptly and reporting concerns within a reasonable time. Clients must provide accurate instructions and obtain any permissions needed for photography, drone operations, staging, marketing, or publication.

Unless otherwise agreed in writing, Peak Property Media retains the copyright and ownership of photographs, videos, designs, and other media it creates.

Upon full payment, the client receives a limited, non-exclusive, non-transferable license to use the delivered media to market the property and for the business purposes agreed upon at booking. Media may not be sold, transferred, materially altered, or used for unrelated properties or purposes without written permission.

Peak Property Media may use completed work for its portfolio, website, social media, demonstrations, and promotional purposes unless the client requests otherwise in writing before the project.

Drone Services

Drone services are subject to weather, airspace restrictions, property conditions, safety requirements, and applicable laws. Peak Property Media may modify, postpone, or decline a drone operation when conditions are unsafe or authorization is unavailable.

Virtual Staging and Editing

Virtual staging, image enhancement, and editing are intended for marketing purposes. Clients are responsible for using such materials in compliance with applicable advertising, MLS, brokerage, and disclosure requirements.

Revisions

Reasonable correction requests related to the agreed scope will be reviewed. Additional editing, changes outside the original scope, or repeated revision requests may require an additional fee.

No Guarantee of Results

Peak Property Media provides creative, media, educational, and marketing services but does not guarantee property sales, listing appointments, leads, engagement, revenue, or any specific business result.

Communications

By providing contact information, you authorize Peak Property Media to contact you regarding your inquiry, booking, consultation, or services.

Marketing emails and promotional text messages will be sent only as permitted by law and consistent with any consent you provide. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out of text messages and HELP for assistance.

Prohibited Use

You may not misuse our website, forms, media, intellectual property, or services; interfere with website operations; submit unlawful or misleading information; or use delivered materials in violation of law or third-party rights.

Third-Party Services

Our website and operations may rely on third-party platforms for hosting, forms, communications, scheduling, payment processing, delivery, or other services. We are not responsible for third-party outages, policies, or actions outside our reasonable control.

Disclaimer and Limitation of Liability

Services and website content are provided on an “as available” basis. To the fullest extent permitted by law, Peak Property Media disclaims implied warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages.

To the fullest extent permitted by law, Peak Property Media’s total liability arising from a specific service will not exceed the amount the client paid for that service.

Indemnification

You agree to indemnify and hold Peak Property Media harmless from claims, losses, or expenses arising from your misuse of the website or delivered media, your violation of these Terms, inaccurate information you provide, or your failure to obtain required permissions.

Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute will be handled in a court of competent jurisdiction in Utah, unless the parties agree to another resolution process.

Changes to These Terms

We may update these Terms periodically. Revised Terms will be posted on this page with a new effective date.
